Launch, Inc. To reproduce, republish, upload, post,
transmit, modify, distribute, or publicly perform or display
material from this site, you must first obtain written
permission from FIT Launch less further conditions met.
You may view and download material from this site for your
personal, non-commercial home use only.
Discussion Forums
If you
participate in any chat rooms, bulletin boards, or other
forum within the site, you agree to not:

defame, abuse, harass or threaten others;

make any bigoted, hateful or racially offensive statements;

advocate illegal activity or discuss illegal activities with
the intent to commit them;

post or distribute any material that infringes and/or
violates any right of a third party or any law;

post or distribute any vulgar, obscene, discourteous or
indecent language or images;

advertise or sell to, or solicit others;
-
post or distribute any software or other materials which
contain a virus or other harmful component; or
-
post material or make statements that do not generally
pertain to the designated topic or theme of any chat room or
bulletin board.
FIT Launch reserves the
right to remove or edit messages or material submitted by
you. FIT Launch is not responsible for material submitted to
FIT Launch or posted in chat rooms, on bulletin boards or on
other forums by users of the site. By communicating with FIT
Launch or participating in any forum in the site you grant
FIT Launch an irrevocable, transferable and worldwide right
to use, reproduce, publicly perform and display, distribute,
sublicense, and sell any information, suggestions, ideas,
drawings or concepts communicated to FIT Launch for any
purpose FIT Launch chooses, commercial, public or otherwise,
without any compensation to you whatsoever.
Return Policy
If you are not completely
satisfied with your order, you may return the unused items
(excluding cds, dvds, videos, audios and printed materials
such as manuals, flash cards, charts, etc.) within 30 days
from the date of invoice for a full refund (excluding
shipping charges and any applicable restocking fees). Please
call 360/568-7448 for a return authorization number, and
follow the return instructions located on back of the
packing slip received with your order. A copy of the packing
slip must accompany all returns. We reserve the right to not
accept returns that are in poor condition, do not have a
return authorization number, or are not accompanied by a
packing slip.
FIT LAUNCH - Healthy Gatherings Products Limited 90-day
warranty
FIT LAUNCH warrants that the products
sold by it are free from manufacturing defects for a period
of 90 days from the invoice date (SPRI Resist-A-Bands® are
excluded from this warranty). Should your product show signs
of defective workmanship or material prior to the expiration
of the 90 day warranty, you should call our customer service
department at 360/568-7448 to receive an exchange
authorization number. This warranty is limited to the
replacement of the product by FIT LAUNCH, and all
transportation, shipping and return costs shall be at your
expense. This warranty does not extend to any defect or
problem caused by the negligence or acts of you or others,
failure to maintain the product in accordance with
instructions furnished with the product, unreasonable use,
accidents, alterations, or ordinary wear and tear. FIT
LAUNCH WILL NOT BE RESPONSIBLE OR LIABLE FOR INDIRECT OR
CONSEQUENTIAL DAMAGES OF ANY KIND, including but not limited
to use of any product, loss of time, inconvenience, or other
incidental or consequential damages with respect to persons,
business or property, whether as a result of breach of
warranty, negligence or otherwise. FIT LAUNCH PRODUCTS
LIABILITY SHALL BE LIMITED SOLELY TO THE REPLACEMENT OF THE
GOODS NOT MEETING THE QUALITY AND SPECIFICATIONS WARRANTED.
NO OTHER WARRANTY, EXPRESSED OR IMPLIED, SHALL APPLY,
INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS
FOR A PARTICULAR PURPOSE, AND ANY SUCH IMPLIED WARRANTIES
ARE EXPRESSLY DISCLAIMED. IN THE EVENT APPLICABLE LAW
PREVENTS THE DISCLAIMER OF ANY IMPLIED WARRANTIES, THEN SUCH
IMPLIED WARRANTY SHALL BE LIMITED TO THE DURATION OF
EXPRESSED WARRANTIES ABOVE.
Any warranties noted above do not apply to
SPRI Resist-A-Bands®, and FIT LAUNCH DISCLAIMS ALL
WARRANTIES, EXPRESS OR IMPLIED, including IMPLIED WARRANTIES
OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Note: Some states do not allow limitations on
how long an implied warranty lasts, so the above limitations
may not apply to you. Some states do not allow the exclusion
on limitation of incidental or consequential damages, so the
above limitations or exclusions may not apply to you. This
warranty gives you specific legal rights, and you may also
have other rights which vary from state to state.
Education and Workshop
Policies
Refunds
Exercise ETC. enforces a no refund policy for all training
programs, materials and services.
Cancellations
In the event that Exercise ETC. cancels any scheduled
training program, full refunds will be issued for persons
registered for the cancelled program. Exercise ETC. is not
liable for any participant fees or changes that may be
associated with the cancellation of a training class
including, but not limited to, travel expenses or exam fees.
Impossibility
In the event of any event outside the control of Exercise
ETC, (including acts of God, war, or terrorism; or due to
government regulations, disaster, strikes or civil disorder)
to the extent that such circumstances make it illegal or
impossible to conduct training sessions, refunds will not be
issued. Exercise ETC. reserves the right to reschedule
training sessions or to issue in-house credit vouchers when
conditions beyond the control of Exercise ETC force
cancellation of training.
Transfer of Registration
Pre-paid participants may transfer their registration to a
third party for a $75.00 transfer charge. Registrant is
responsible for getting class materials to new participant.
Group
Discounts
Groups of 3 or more people are eligible for a 10% discount
off of their registration fees. To be eligible for this
discount, Customer Service must receive a master list with
the names of all members of the group, as well as contact
information for the coordinator of the group. Each member of
the group can then register at their convenience by phone,
fax, internet or US mail. Participants whose names are not
on the master list will not be eligible for the group
discount. Group discounts are only available for
pre-registered participants; we are not able to process
group registrations on site at the training venue; in
addition, once a participant has registered for a training
program they are not eligible for any subsequent group
discounts that may be approved or negotiated.
